India Power of Attorney Notarization, Apostille and VFS Requirements

What Is an India Power of Attorney?
An India power of attorney allows an individual, known as the principal, to authorize another person to act on the principal’s behalf in India. These documents are commonly used to purchase, sell, manage, or register real estate; conduct banking or financial transactions; and complete other legal or administrative matters.
The document must be prepared and signed according to the requirements of the receiving authority in India. Depending on the transaction and the principal’s citizenship, passport, or OCI status, the process may involve notarization, witnesses, an apostille, VFS consular certification, identification copies, photographs, or other supporting documents.
Does an India Power of Attorney Need an Apostille?
Not always. Although India and the United States are parties to the Hague Apostille Convention, the correct process can depend on:
Whether the principal holds a valid Indian passport
Whether the principal holds an Overseas Citizen of India (OCI) card
The type of transaction being completed
The requirements of the state or local authority in India
The instructions of the attorney, bank, registrar, or other recipient
The required process must be confirmed directly with VFS Global and the receiving authority in India before the document is signed or notarized. We cannot determine whether a particular power of attorney requires an apostille, consular attestation, witnesses, photographs, identification copies, or other supporting documents.
When an apostille is required for a California-notarized power of attorney, it is issued by the California Secretary of State. The apostille authenticates the California notary public’s signature and commission. It does not certify the contents of the POA, establish its legal validity, or guarantee that the document will be accepted in India.
Special Requirements for India Real Estate Powers of Attorney
Depending on the instructions provided by VFS Global and the receiving authority in India, requirements may include:
Signing in the presence of two witnesses
Obtaining the witnesses’ signatures on the POA
Providing photocopies of the witnesses’ identification
Having identification copies or supporting declarations notarized
Submitting a copy of an Indian passport, U.S. passport, or OCI card
Providing photographs or other supporting documents
Completing VFS forms and obtaining consular certification
Requirements may differ depending on the Indian state, the type of property transaction, and the authority receiving the document. Before scheduling a notarization, ask VFS and the receiving attorney or authority in India for a written list of everything that must be signed, witnessed, notarized, apostilled, or submitted.
Confirming these requirements in advance can help prevent repeat notarizations, unnecessary apostilles, rejected applications, additional shipping charges, and costly delays.
VFS Now Handles India Consular-Attestation Services
Effective August 1, 2025, the Consulate General of India in San Francisco began directing miscellaneous consular-attestation services, including power-of-attorney matters, through VFS Global.
Applicants should contact VFS Global and obtain the current requirements before signing or notarizing the document. As of September 2026, VFS states that its dedicated telephone-support service includes five free minutes per week. Additional time is charged at the current per-minute rate. How to Get Clear Answers From VFS
Before contacting VFS, review its current Power of Attorney and Affidavit Checklist. Requirements can change, so download a new copy rather than relying on an older checklist saved on your computer.
When contacting VFS, be prepared to explain:
Whether the signer is an Indian citizen, OCI cardholder, or foreign citizen
Where the signer currently resides in the United States
The purpose of the power of attorney
The Indian state where the document will be used
Whether the transaction involves real estate, banking, litigation, or another matter
Which attorney, bank, registrar, court, or government authority will receive the document

Must the power of attorney receive consular attestation through VFS?
Must it receive a state apostille before it is submitted to VFS?
How many witnesses are required?
Must the witnesses sign in front of the notary?
Must copies of the witnesses’ identification be included or notarized?

Which passport, OCI, immigration-status, and address documents must be notarized?
Which VFS application form and checklist apply?
Which Indian Consulate and VFS application center have jurisdiction based on the signer’s U.S. residence?
