How to Obtain and Apostille a California Confidential Marriage Certificate

Need a certified copy of a confidential marriage certificate for use in another country? SF Notary + Apostille can receive the certificate, obtain the California apostille, and ship the completed document anywhere in the United States or internationally.

Confidential marriage certificates are subject to much stricter access rules than public marriage records. We cannot retrieve a confidential marriage certificate for you using a limited power of attorney. However, eligible applicants can order the certificate through VitalChek, complete the required notarized Sworn Statement, and have the certified copy shipped directly to our San Francisco office for apostille processing.

Who Can Obtain a Confidential Marriage Certificate?

A California confidential marriage certificate is not a public record. A certified copy may generally be issued only to:

  • Either of the two parties named on the confidential marriage certificate

  • A person entitled to receive the record under a court order

If access is based on a court order, the issuing county may require a certified copy of the court order with the application.

Unlike a public marriage certificate, a confidential marriage certificate cannot ordinarily be obtained by a relative, attorney-in-fact, document-retrieval company, or other representative using a power of attorney.

For this reason, SF Notary + Apostille cannot visit the County Clerk and retrieve your confidential marriage certificate for you, even if you sign a limited power of attorney.

Order from the County that Issued the Marriage License

You must order the confidential marriage certificate from the California county in which the confidential marriage license was issued and registered. This is true even if the wedding ceremony took place in another county.

The California Department of Public Health does not issue copies of confidential marriage certificates.

Obtain the Certificate Yourself in Person

An eligible applicant may request the confidential marriage certificate in person from the County Clerk.

Confidential marriage certificates are generally issued by the County Clerk, not the County Recorder or Assessor-Recorder office that issues public marriage certificates. Confirm the correct office before visiting.

Bring valid, unexpired government-issued photo identification and verify the county’s current hours, fees, payment methods, and application requirements in advance.

Best Option if You Do Not Live Near the County: Order Through VitalChek

For eligible applicants who cannot appear in person, ordering through VitalChek is usually the most convenient option.

VitalChek is an authorized third-party ordering service used by many California counties. During the online order, you will provide information identifying the marriage record, confirm your eligibility, pay the required fees, and complete the identity-verification requirements.

The application will ordinarily include a Sworn Statement that must be signed and notarized. After completing VitalChek’s requirements, you can have the certified confidential marriage certificate mailed directly to:

You must still be one of the parties named on the marriage certificate or someone entitled to receive the certificate under a court order. Listing our office as the delivery address does not make us the applicant. It simply allows us to receive the certificate and begin the apostille process without requiring you to receive and forward it yourself.

After placing the order, email the VitalChek confirmation to info@sfnotary.com and tell us the country in which the apostilled certificate will be used.

Remote Online Notarization May Be Available

Some California counties, including Marin and San Francisco Counties, now permit eligible applicants ordering through VitalChek to have the required Sworn Statement remotely notarized.

Remote Online Notarization (RON) allows you to appear before a commissioned online notary using secure audio-video technology instead of meeting with a notary in person. Depending on the online notary provider’s requirements, you may be able to complete the notarization even if you are outside the United States.

You will generally need:

  • A computer, smartphone, or tablet with a camera and microphone

  • Reliable internet access

  • Acceptable government-issued identification

  • The ability to complete the online notary provider’s identity-verification process

VitalChek’s ordering system will determine whether remote online notarization is available for the county processing your request. If that county does not accept remote notarization of the Sworn Statement, VitalChek ordinarily will not offer it as an option.

Follow the instructions generated for your specific order. Do not arrange remote online notarization independently unless VitalChek’s instructions confirm that it will be accepted.

What if Remote Online Notarization Is Not Available?

If VitalChek does not offer electronic notarization for your order, the Sworn Statement must be notarized using another method accepted by the issuing county.

If You Are in the United States

You can sign the Sworn Statement before a U.S. notary public. The notary may be commissioned in any U.S. state, subject to the issuing county’s requirements.

After the notarization is complete, follow VitalChek’s instructions to upload or fax the application and notarized Sworn Statement.

If You Are Outside the United States

Do not have the Sworn Statement notarized by a local foreign notary unless VitalChek or the issuing county expressly confirms that the notarization will be accepted.

If remote online notarization is unavailable, you may need to have the Sworn Statement notarized by an authorized U.S. consular official at a U.S. embassy or U.S. consulate in the country where you are located.

The fact that you are overseas does not necessarily prevent you from ordering the certificate. It may simply affect who must notarize the Sworn Statement.

After the application and Sworn Statement have been properly notarized, follow VitalChek’s instructions to upload or fax them.

Requirements vary by county, so review the instructions for your specific order before arranging an overseas notarial appointment.

Uploading or Faxing the Notarized Sworn Statement

VitalChek allows applicants to upload or fax the completed application and notarized Sworn Statement. This saves considerable time because you do not need to mail the original notarized application to the county.

VitalChek will provide the upload or fax instructions associated with your order. Make sure every required page is complete and legible before submitting it.

Direct delivery avoids the time and expense of having the certificate shipped to you and then forwarding it to our office.

Apostilling a Confidential Marriage Certificate

Once we receive the original certified confidential marriage certificate, we can obtain the California apostille and ship the completed document to its final destination.

Tell us the country where the certificate will be presented so we can confirm the appropriate authentication process. Documents intended for countries that do not participate in the Hague Apostille Convention may require additional authentication or embassy or consulate legalization.

Frequently Asked Questions

Can SF Notary + Apostille pick up my confidential marriage certificate?

No. A limited power of attorney does not authorize us to retrieve a confidential marriage certificate.

The certificate may generally be released only to one of the two parties named on the record or to a person entitled to receive it under a court order.

We can receive the certificate after an eligible applicant orders it, obtain the apostille, and ship the completed document to its final destination.

Can a relative order the certificate for me?

No. Not even if the person is your parent, child, sibling, grandparent, spouse, or another relative.

Confidential marriage records have much narrower access rules than public marriage records. Unless the person is one of the two parties named on the confidential marriage certificate, the person generally needs a qualifying court order.

Can I use a power of attorney?

No. While a limited power of attorney allows an agent to obtain copy of a public marriage certificate, it does not authorize the agent to obtain a confidential marriage certificate.

Can the certificate be mailed directly to SF Notary + Apostille?

Yes, when VitalChek permits you to enter a different delivery address.

You remain the applicant, but you can list our San Francisco office as the delivery address. This allows us to begin the apostille process as soon as the certificate arrives.

Can I have the Sworn Statement remotely notarized?

Possibly. Remote Online Notarization (RON) is available for some VitalChek orders, including orders processed by Marin and San Francisco Counties.

Availability depends on the issuing county and the particular VitalChek order. Follow the notarization instructions generated during the ordering process.

If remote online notarization is not offered, do not assume that a remotely notarized Sworn Statement arranged independently will be accepted.

Can I complete Remote Online Notarization while outside the United States?

Possibly. Some remote online notary providers can notarize documents for signers located outside the United States, provided the signer has acceptable identification and can complete the required identity-verification process.

The notarization must also be permitted for your particular VitalChek order. Follow the instructions provided during the ordering process.

Can I upload or fax the notarized application?

Yes. VitalChek allows applicants to upload or fax the completed application and notarized Sworn Statement. Follow the submission instructions associated with your order.

Can a foreign notary notarize my Sworn Statement?

Do not assume that a notarization performed by a local foreign notary will be accepted.

If you are outside the United States and Remote Online Notarization is unavailable, you may need to have the Sworn Statement notarized by an authorized U.S. notary at a U.S. embassy or U.S. consulate.

Follow VitalChek’s instructions and confirm the issuing county’s requirements before arranging the notarization.

Does the marriage certificate itself need to be notarized?

No. The confidential marriage certificate is certified by the County Clerk who issued it.

The application’s Sworn Statement must generally be notarized, but the marriage certificate itself should not be separately notarized or altered.

Can a photocopy or scan be apostilled?

No. For this process, we need the original certified copy issued by the County Clerk. A plain photocopy, emailed scan, or printout is not sufficient.

Is ordering through VitalChek as fast as having a public marriage certificate picked up?

Usually not.

An authorized representative can often retrieve a public marriage certificate using a properly prepared limited power of attorney. That option is not available for a confidential marriage certificate.

The eligible applicant must place the order, complete VitalChek’s identity-verification and notarization requirements, and wait for the county to issue and ship the certificate.

Although the process takes longer, it is generally much less expensive and more convenient than traveling to California solely to obtain the certificate in person.
